A Associação dos Ex-Militares das Forças Armadas Portuguesas na Guiné promete avançar com queixas contra Portugal nas instâncias juidiciais da UE.
Os ex-soldados guineenses que serviram o exército português durante a guerra colonial escolheram esta quarta-feira, precisamente o dia 25 de Abril, para realizar "uma marcha silenciosa e pacífica" até à Embaixada de Portugal em Bissau. Os manifestantes acusam os sucessivos governos portugueses, bem como as autoridades guineenses, de incumprimento dos acordos de Argel, que lhes dava direito a pensões de reforma com a independência da Guiné-Bissau.
Segundo o porta-voz da AMFAP- Associação dos Ex-Militares das Forças Armadas na Guiné, que reúne mais de seis mil ex-soldados, "Portugal, lamentavelmente, diz agora que já não somos portugueses, esquecendo-se que lutamos servindo a bandeira e a Pátria portuguesas". Rui Ferreira queixa-se de que nem a Embaixada de Portugal os trata com dignidade.
Ao alegar que os ex-soldados já não são portugueses e que o caso, por isto, tem de ser tratado entre os dois Estados, Portugal tem adoptado uma "atitude esperta", com vista a "ganhar tempo" para não pagar as referidas pensões, afirma este antigo deputado à Assembleia Nacional Popular (ANP). Para Rui Ferreira, Portugal está, na verdade, esperando "pela lenta morte dos ex-militares naturais da Guiné".
"É uma estratégia esperta, mas infeliz porque não respeita a palavra dada", afirma, defendendo que Portugal devia seguir o exemplo de França que, 40 anos depois, continua a regularizar a situação daqueles que lutaram pela bandeira francesa.
O protesto dos ex-soldados vai também para as autoridades guineenses, acusadas de "atitudes discriminatórias", na medida em que não são abrangidos pelos programas nacionais de reinserção ou reintegração social. "Somos humilhados no nosso país por termos servido a bandeira portuguesa, mas agora ninguém quer saber de nós".

PSD propõe criação do crime de enriquecimento ilícito

O líder do PSD propôs hoje a criminalização do crime de enriquecimento ilícito para titulares de cargos públicos, cabendo às autoridades fazer prova da disparidade entre os rendimentos do investigado e o seu património e estilo de vida.

«O enriquecimento ilícito tem de ser crime, Quem enriquece de forma ilegítima tem que ser penalizado», afirmou o líder social-democrata, Luís Marques Mendes, no encerramento do colóquio organizado pelo grupo parlamentar do PSD, que decorreu desde segunda-feira em Cascais.
Salientando que «a sociedade sente que há um dano grave quando é gritante a disparidade entre os rendimentos de um servidor do Estado e o seu património ou o seu modo de vida», Marques Mendes defendeu ser necessário ir mais além dos habituais «juízos de censura».
«A censura não pode apenas ser social. Tem de ser também uma censura legal e criminal», disse, considerando a criminalização do enriquecimento ilícito como «uma questão essencial» no âmbito do combate à corrupção.
A questão da criminalização do enriquecimento ilícito foi levantada pelo ex-deputado socialista João Cravinho durante a preparação das propostas de combate à corrupção que viria a apresentar no final de Janeiro na Assembleia da República, dias antes de renunciar ao mandato de deputado.
Contudo, entre as iniciativas que apresentou, João Cravinho não chegou a incluir a criação do crime de enriquecimento ilícito, uma proposta criticada pela própria bancada socialista, com o argumento de que seria inconstitucional, pois iria colocar em causa o princípio da presunção de inocência.
Durante o debate do «pacote», a 22 de Fevereiro, das propostas que todos os partidos apresentaram no âmbito do combate à corrupção, a criação do crime de enriquecimento ilícito não estava entre as propostas dos sociais-democratas.
Apenas o PCP entregou um projecto sobre essa matéria, propondo a criação do crime de «enriquecimento injustificado».

Meanwhile, European Commission president Jose Manuel Barroso expressed unease with the prospect of a second Dutch constitution referendum talking to Dutch papers ahead of a visit to The Hague later this week.
‘Referendums make the process of approval of European treaties much more complicated and less predictable,’ he said, asking ‘every member state’ considering a referendum to ‘think twice,’ according to Het Financieele Dagblad.
Mr Barroso in his previous job as Portuguese prime minister in 2004 backed a referendum on the EU constitution in his own country – but since then his thinking has changed, he indicated.
‘I was in favour of a referendum as a prime minister, but it does make our lives with 27 member states in the EU more difficult. If a referendum had been held on the creation of the European Community or the introduction of the euro, do you think these would have passed?’ the commission chief asked according to De Volkskrant.
Mr Barroso also told the Netherlands, which until now has been largely silent on what it wants to see changed in a new EU treaty, to contribute to a solution to the deadlock produced by the French and Dutch ‘no’ votes.
‘If you have signed a treaty, you should also ratify it,’ he stated. ‘And if you can’t, you should at least contribute to a solution.’

Mixed-up emotions 'bad for the euro'

European Union officials yesterday blamed "mixed up" people for letting emotions get in the way of a proper appreciation of the euro.
The remark came in response to a new FT-Harris poll which shows that most of the eurozone's citizens would like to have their old, comfortable national currencies back.
Feelings are particularly strong in Germany, the present holder of the EU's rotating presidency and Europe's largest economy.
Two thirds of Germans now prefer the Deutschmark to the euro and more than half believe that the European single currency has damaged their country's economy.
But the European Commission insists that ordinary people are simply failing to grasp the benefits of the single currency.
"The danger we see with these surveys is that they contribute to enforcing what in the end are impressions, gut feelings, rather than facts," said a commission spokesman.
Brussels is particularly exercised by survey results showing that more than two thirds of French, Italian and Spanish people believe that the euro has had a negative economic impact.
"We should always treat surveys with extreme caution because of the tendency of people to mix things up," the spokesman added.
Derek Scott, Tony Blair's economic adviser between 1997 and 2003, said he was unimpressed, if unsurprised, by the EU reaction.
"We saw this with the EU constitution too," he said. "The knee-jerk response of bureaucrats is blame people for not understanding."
Mr Scott argued that evidence against the euro is mounting as the one-size-fits-all currency hampers economic and fiscal policy in countries such as Germany.
"People are quite right," he said. "We are just beginning to see a crisis that will, in two or three years, become absolutely clear."
EU officials are growing increasingly concerned that buoyant European economic growth is failing to translate into popular support.
French and Dutch referendum rejections of the EU constitution in 2005 have reinforced fears in Brussels that Europe's institutions, including the single currency, are a lightning rod for popular discontent.
"We have warned countless times against using the euro as a scapegoat," said the commission spokesman.

Indemnizações avultadas

Empresas públicas pagaram mais de cinco milhões de euros a gestores que cessaram funções, revela Tribunal de Contas

Dez empresas públicas pagaram 5,137 milhões de euros de indemnizações a gestores que cessaram funções antes do fim do mandato, entre 2003 e 2006, revela uma auditoria divulgada esta quinta-feira pelo Tribunal de Contas (TC).

Na auditoria "de seguimento de recomendações" feita a 25 empresas públicas, o TC aponta que a empresa que mais dinheiro pagou em indemnizações a administradores foi a Caixa Geral de Depósitos (CGD), que desembolsou 4,202 milhões de euros.

A segunda maior conta cabe à transportadora aérea TAP Portugal, que pagou 456 mil euros em indemnizações, seguindo-se três empresas do sector do transporte ferroviário que, em conjunto, pagaram 313 mil euros.

Individualmente, no transporte ferroviário, a Refer, empresa que gere a rede ferroviária nacional, pagou 134 mil euros; a Rave, responsável pelo projecto da rede ferroviária de alta velocidade, desembolsou 134 mil euros; e, a CP, que gere o negócio dos comboios, pagou 61 mil euros.

A lista feita pelo TC fica completa com a Ferbritas, o Hospital de S. João, o IPO - Porto, o Centro Hospitalar de Setúbal e a EDAB, que, em conjunto, pagaram 166 mil euros.

O TC alerta também para o facto de que o valor global pago em indemnizações poderá aumentar, porque, no caso da Águas de Portugal, existe um contencioso ainda não solucionado.

O tribunal diz que, em geral, não foram explicitados os motivos que justificaram o termo dos mandatos antes do seu final, sendo invocada "a iniciativa do accionista".

A instituição que fiscaliza as contas públicas observa, no entanto, que em muitas situações a cessação dos mandatos coincide com a mudança dos titulares das pastas governamentais que tutelam as empresas onde há mudanças.

O TC considera que as cessações antes do termo previsto deveriam ser evitadas para que não houvesse pagamento de pesadas indemnizações e porque "podem afectar a boa imagem que as empresas do estado devem sempre ostentar".

No relatório divulgado, a instituição presidida por Guilherme de Oliveira Martins recomenda ao Estado accionista que, em caso de cessação antecipada dos mandatos dos gestores públicos por sua iniciativa, "justifique claramente a sua decisão em nome do princípio da transparência".

Experiments that claim to ‘cure’ homosexual rams spark anger
SCIENTISTS are conducting experiments to change the sexuality of “gay” sheep in a programme that critics fear could pave the way for breeding out homosexuality in humans.
The technique being developed by American researchers adjusts the hormonal balance in the brains of homosexual rams so that they are more inclined to mate with ewes.
It raises the prospect that pregnant women could one day be offered a treatment to reduce or eliminate the chance that their offspring will be homosexual. Experts say that, in theory, the “straightening” procedure on humans could be as simple as a hormone supplement for mothers-to-be, worn on the skin like an anti-smoking nicotine patch.
The research, at Oregon State University in the city of Corvallis and at the Oregon Health and Science University in Portland, has caused an outcry. Martina Navratilova, the lesbian tennis player who won Wimbledon nine times, and scientists and gay rights campaigners in Britain have called for the project to be abandoned.
Navratilova defended the “right” of sheep to be gay. She said: “How can it be that in the year 2006 a major university would host such homophobic and cruel experiments?” She said gay men and lesbians would be “deeply offended” by the social implications of the tests.
But the researchers argue that the work is valid, shedding light on the “broad question” of what determines sexual orientation. They insist the work is not aimed at “curing” homosexuality.
Approximately one ram in 10 prefers to mount other rams rather than mate with ewes, reducing its value to a farmer. Initially, the publicly funded project aimed to improve the productivity of herds.
The scientists have been able to pinpoint the mechanisms influencing the desires of “male-oriented” rams by studying their brains. The animals’ skulls are cut open and electronic sensors are attached to their brains.
By varying the hormone levels, mainly by injecting hormones into the brain, they have had “considerable success” in altering the rams’ sexuality, with some previously gay animals becoming attracted to ewes.
Professor Charles Roselli, the Health and Science University biologist leading the research, defended the project.
He said: “In general, sexuality has been under-studied because of political concerns. People don’t want science looking into what determines sexuality.
“It’s a touchy issue. In fact, several studies have shown that people who believe homosexuality is biologically based are less homophobic than people who think that this orientation is acquired.”
The research is being peer-reviewed by a panel of scientists in America, demonstrating that it is being taken seriously by the academic community.
Potentially, the techniques could one day be adapted for human use, with doctors perhaps being able to offer parents pre-natal tests to determine the likely sexuality of offspring or a hormonal treatment to change the orientation of a child.
Roselli has said he would be “uncomfortable” about parents choosing sexuality, but argues that it is up to policy makers to legislate on questions of ethics.
Michael Bailey, a neurology professor at Northwestern University near Chicago, said: “Allowing parents to select their children’s sexual orientation would further a parent’s freedom to raise the sort of children they want to raise.”
Critics fear the findings could be abused.
Udo Schuklenk, Professor of Bioethics at Glasgow Caledonian University, who has written to the researchers pressing them to stop, said: “I don’t believe the motives of the study are homophobic, but their work brings the terrible possibility of exploitation by homophobic societies. Imagine this technology in the hands of Iran, for example.
“It is typical of the US to ignore the global context in which this is taking place.”
Peter Tatchell, the gay rights campaigner, said: “These experiments echo Nazi research in the early 1940s which aimed at eradicating homosexuality. They stink of eugenics. There is a danger that extreme homophobic regimes may try to use these experimental results to change the orientation of gay people.”
He said that the techniques being developed in sheep could in future allow parents to “play God”.
People for the Ethical Treatment of Animals, the pressure group, condemned the study as “a needless slaughter of animals, an affront to human dignity and a colossal waste of precious research funds”.
The tests on gay sheep are the latest in a long line of experiments seeking to alter the sexuality of humans and animals.
Günther Dorner, a scientist in the former East Berlin, carried out hormone-altering tests on rodents in the 1960s in the hope of finding a way to eradicate homosexuality.
In 2002, Simon LeVay, an American neurologist, claimed to have discovered that homosexual and heterosexual men had physically different brains. His tests on the corpses of gay men who had died of Aids were widely criticised.

Paris Mayor Opposes Racist Soup
Last week, the Paris police issued a prohibition on the distribution to the homeless of soup containing pork meat or fat. According to the police authorities – the same ones who are incapable of restoring law and order in the Paris suburbs – distributing soup containing pork or lard is a racist offence since some people in need might be Muslim and hence not allowed to eat pork. Yesterday, however, an administrative court of first instance in Paris ruled that distributing pork soup is not racist. Today Bertrand Delanoë, the Mayor of Paris, told the Paris police to appeal the court ruling.
Pork has been on the European menu since time immemorial. In the winter of 2004 Solidarité des Français (SdF), a charity organization running a soup kitchen, began to distribute “soupe au cochon” (pork soup). SdF is a private organization and is said to be closely allied with “islamophobic” groups. According to critics it put pork soup on the menu to exclude Muslims. The organization says that the soup is a traditional French recipe with origins dating back to Gallic times. Even Asterix and Obelix ate pork soup.
On 28 December the Paris police prefecture issued a prohibition on the distribution of the soup, denouncing the “xenophobic character of a charity that excludes people of Jewish and Muslim confessions.” Paris police officers had to enforce the prohibition. This time the policemen did not need to enter certain Paris suburbs because the ruling sharia authorities in those no-go areas ensure that no pork soup is served there.
Yesterday’s court ruling, which again allowed the serving of pork soup, was criticized by Bertrand Delanoë. The Paris mayor said he was “astonished” to learn that the court tolerates an initiative which “knowingly excludes Jews and Muslims.” “Confronted with this xenophobic initiative, I want to express again that the city denounces and opposes every form of discrimination, racism and anti-Semitism,” the mayor said. He asked the police prefecture to appeal the verdict.
Frédéric Pichon, the lawyer of SdF said: “There has never been any discrimination. No-one has been denied the offer of soup on the basis of his clothes, appearance, religion or race.”
Mayor Delanoë is a Socialist and an outspoken homosexual. Religious Muslims oppose homosexuality at least as much as they oppose pork soup. If the mayor considers it a racist hate crime for a private organization to offer the homeless pork soup when some of the homeless might be Muslims, he may ponder the question whether it is not a racist hate crime for a city to have a gay mayor when some of the city’s citizens are Muslims.

Opa à PT desce preço do telefone fixo mas não do móvel
O presidente da Autoridade da Concorrência (AdC) afirmou ontem que as comunicações baseadas na rede fixa (voz e Internet) vão baixar 14% caso a OPA lançada pela Sonaecom à PT se concretize. No mercado móvel, Abel Mateus não quis comprometer-se com números, dizendo apenas que "à medida que entrarem novos operadores haverá pressão para descer preços". A curto prazo não deverá haver alterações.Na sua decisão final, a AdC não se opõe à concentração das duas empresas de telecomunicações, mediante a aplicação de condições e obrigações. "É uma operação histórica para a AdC e para o País que irá beneficiar os consumidores portugueses", sustentou Abel Mateus.Sobre esses benefícios, os que parecem menos evidentes são os da rede móvel, já que a fusão da Optimus com a TMN levará à criação de um operador com mais de 60% de quota de mercado. Um estudo feito por Pedro Pereira, consultor da AdC, e Tiago Ribeiro, da Indera - Estudos Económicos concluiu que com a fusão Optimus/TMN cada família passaria a gastar anualmente mais 6,3% nas comunicações móveis. Questionado sobre esse documento, Abel Mateus frisou que a estimativa foi feita num cenário em que não existiam compromissos colocados à operação. "Com os remédios (...) não existe perigo para se registar uma subida de preços". Além disso, "à medida que entrarem novos operadores [quer com rede própria quer virtuais] haverá pressão para uma descida de preços". A Vodafone tem uma posição contrária, ao considerar que a fusão será prejudicial para os consumidores. Carlos Correia, director de regulação da Vodafone, afirmou ao DN que esta operação vai também prejudicar a sua operadora, razão pela qual admite impugnar a decisão de Abel Mateus. O recurso aos tribunais está igualmente a ser estudado pela Portugal Telecom.Sobre esta possibilidade, o presidente da AdC afirmou que "qualquer operador que se sinta lesado pode ir para tribunal", acrescentando que a AdC "fez o melhor trabalho possível de acordo com os padrões nacionais e internacionais".Confiante na decisão apresentada, Abel Mateus destacou que "estamos descansados" porque o trabalho de análise da operação é suficiente para "suportar a decisão". O presidente da AdC revelou que foram feitos 25 estudos no decorrer da análise à OPA e que foram consultadas 56 entidades, nacionais e estrangeiras no decorrer do processo. Também os operadores do mercado, acrescentou, foram consultados por quatro vezes, tendo existido uma "relação bastante íntima com o regulador sectorial [a Anacom], ao qual foram pedidos quatro pareceres. Abel Mateus considera que se a OPA tiver sucesso o sector das telecomunicações, que vale 7,5 mil milhões de euros, sofrerá uma alteração na estrutura concorrencial.

There would be uproar, with a high-powered delegation of ‘senior Muslims’ to Downing Street demanding national repentance and a global apology, to which the Prime Minister would doubtless acquiesce.
In this instance, the sensitivities of other faith groups and the demands of the animal rights activists are subjugated to the demands of the Muslims.
